Terms of service

These terms govern your use of bike88.us and any purchase you make from Bike 88, LLC. By using this site or placing an order, you agree to them.

1. Who we are

Bike 88, LLC is a Texas limited liability company, Texas SOS file no. 806613487, with its corporate office in Houston, Texas. In these terms, "we", "us" and "Bike 88" mean Bike 88, LLC.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. We sell only to end customers in the United States. We do not knowingly sell for resale, export or fulfillment by a freight forwarder, and we may cancel orders that appear to be for those purposes.

3. Products and descriptions

We work to describe products accurately, but specifications, weights, colors and images are provided by manufacturers and may change without notice. Colors can render differently on different screens. A product listing is an invitation to order, not a binding offer.

4. Pricing

Prices are in U.S. dollars and exclude sales tax and shipping unless stated. We may change prices at any time. Sales tax is calculated at checkout based on your delivery address and applicable law.

If a product is listed at a materially incorrect price because of a typographical or system error, we may cancel the order even after it is confirmed. If your payment has been taken, we will refund it in full.

5. Orders and acceptance

An order confirmation acknowledges receipt; it does not constitute acceptance. The contract is formed when we dispatch the goods. We may decline or cancel an order, including where stock is unavailable, where we suspect fraud, or where the order breaches these terms.

6. Payment

Payment is taken through our payment processor at the time of order. You confirm that you are authorized to use the payment method presented.

7. Shipping, returns and warranty

Delivery is governed by our shipping policy, returns by our returns and refunds policy, and product defects by our warranty page. Those pages form part of these terms.

Risk of loss passes to you on delivery by the carrier. Title passes on full payment.

8. Assembly and safe use

Bike 88 does not operate a workshop and does not perform final assembly. Bicycles ship partially assembled and must be assembled, adjusted and safety-checked before use. We strongly recommend that a qualified bicycle mechanic complete final assembly.

Cycling carries inherent risk of serious injury or death. You are responsible for riding within your ability, wearing appropriate protective equipment, maintaining your equipment, and complying with all applicable traffic and trail regulations. Use each product only for its intended discipline as specified by the manufacturer.

Electric bicycles are subject to state and local regulation, including class definitions, speed limits, age restrictions and where they may be ridden. Confirming that a product is legal where you intend to ride it is your responsibility.

9. Acceptable use

You agree not to:

• Use the site for any unlawful purpose
• Attempt to gain unauthorized access to any part of the site or its systems
• Scrape, harvest or systematically extract content or pricing
• Interfere with the operation or security of the site
• Submit false, misleading or fraudulent information

10. Intellectual property

The Bike 88 name, the Bike 88 logo, the site design and its original content are the property of Bike 88, LLC and are protected by U.S. and international law. You may not use them without our prior written permission.

Third-party brand names, logos and product images remain the property of their respective owners and are used only to identify products.

11. Third-party links

This site may link to third-party sites. We do not control them and are not responsible for their content, products or privacy practices.

12. Disclaimer of warranties

Except as expressly stated in these terms or required by law, this site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free.

This section does not affect the manufacturer warranties described on our warranty page, nor any rights you have under applicable consumer protection law that cannot lawfully be excluded.

13. Limitation of liability

To the fullest extent permitted by law, Bike 88, LLC and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising out of your use of this site or any product purchased through it.

Our total aggregate liability arising out of or relating to any order will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnity

You agree to indemnify and hold harmless Bike 88, LLC against any claim, loss or expense, including reasonable attorneys' fees, arising from your breach of these terms or your misuse of any product.

15. Governing law and venue

These terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.

16. Changes to these terms

We may revise these terms at any time. The version in effect when you place an order governs that order. Continued use of the site after a revision constitutes acceptance of the revised terms.

17. Severability and entire agreement

If any provision is found unenforceable, the remainder stays in effect. These terms, together with the shipping, returns, warranty and privacy pages, are the entire agreement between you and Bike 88, LLC regarding this site.
